NOTICE OF REGULAR CITY COUNCIL MEETING

NOTICE IS HEREBY GIVEN THAT THE SEABROOK CITY COUNCIL WILL MEET ON TUESDAY SEPTEMBER 5, 2017 AT 7:00 PM IN THE CITY HALL CITY COUNCIL CHAMBERS, 1700 FIRST STREET, SEABROOK, TEXAS, TO DISCUSS, CONSIDER, AND IF APPROPRIATE, TAKE ACTION WITH RESPECT TO THE ITEMS LISTED BELOW.

3.1     Approve on second reading proposed Ordinance 2017-31, "Adding 'Use of Public Right-Of-Way' to the City of Seabrook Code of Ordinances"  (Craig)

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SEABROOK, TEXAS, CHAPTER 75, “STREEETS, SIDEWALKS AND OTHER PUBLIC PLACES”, BY ADDING A NEW  ARTICLE III ENTITLED “USE OF PUBLIC RIGHT-OF-WAY”, IN ORDER TO ADMINISTER AND REGULATE THE USE OF PUBLIC RIGHTS-OF-WAY FOR THE PUBLIC INTEREST, HEALTH, SAFETY AND WELFARE; PROVIDING FOR THE ISSUANCE AND REGULATION OF PERMITS; ESTABLISHING FEES; PROVIDING FOR A PENALTY IN AN AMOUNT NOT TO EXCEED $500 PER OFFENSE FOR VIOLATION OF ANY PROVISION HEREOF BY INCLUSION INTO THE CODE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY.

AN ORDINANCE AMENDING THE CODE OF THE CITY OF SEABROOK, TO UPDATE “APPENDIX B”, ENTITLED “MASTER FEE SCHEDULE” BY ADDING PERMIT FEES FOR WORK IN CITY OWNED RIGHT OF WAY; MAKING CORRECTIONS TO TYPOGRAPHICAL ERRORS; MAKING FINDINGS OF FACT; REPEALING AND REPLACING ALL REFERENCES TO SUCH FEES AND CHARGES IN ALL ORDINANCES  OR RESOLUTIONS IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR NOTICE AND EFFECTIVE DATE.

3.3     Approve on second of two readings proposed Resolution 2017-18, "EDC Project Designation for Façade Improvement Incentive Program and Incentives for Y.M. Properties, LLC for Commercial Building at 2825 Nasa Road 1."  (Chavez)   ATTACHMENT:  Resolution 2017-18

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEABROOK, TEXAS, AUTHORIZING A PROJECT OF THE SEABROOK ECONOMIC DEVELOPMENT CORPORATION FOR THE FACADE IMPROVEMENT INCENTIVE PROGRAM TO PROVIDE BUSINESS INCENTIVES TO Y.M. PROPERTIES, LLC PURSUANT TO THE TERMS AND CONDITIONS OF THE "ECONOMIC DEVELOPMENT AGREEMENT", ATTACHED HERETO.


3.4     Approve Economic Development Agreement between the Seabrook Economic Development Corporation and YM Properties LLC for relocation of a business to Seabrook and construction of a new facility in an amount not to exceed $13,875.50 for façade improvements, signage and related landscaping.  (Chavez)   ATTACHMENTS:  Agenda Briefing   Agreement

3.5     Approve the three-year renewal of the Contract between the Seabrook Economic Development Corporation and The Bay Area Houston Economic Partnership (BAHEP) for economic development services to the Seabrook Economic Development Corporation from October 1, 2017 thru September 30, 2020, in an amount not to exceed $20,000 per year. NEW BUSINESS

4.1     Consider and take all appropriate action on first and final reading of proposed Ordinance 2017-35, "Emergency Ordinance Temporarily Suspending Building Permit Fees for Residential and Commercial Structures". (Cook)

AN EMERGENCY ORDINANCE OF THE CITY OF SEABROOK, TEXAS, TO TEMPORARILY SUSPEND BUILDING AND PERMIT FEES IN SPECIFIC RESPONSE TO WIDESPREAD DAMAGE CAUSED BY HURRICANE HARVEY IN ACCORDANCE WITH DECLARATION OF DISASTER, SUBJECT TO SPECIFIC CONDITIONS; MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING FOR PENALTIES.

4.2     Consider and take all appropriate action on the first and final reading of proposed Ordinance 2017-34 "Termination of Curfew"  (Kolupski)

AN ORDINANCE PROVIDING FOR TERMINATION OF CURFEW AS PROVIDED IN ORDINANCE 2017-33, WITHOUT REPEALING OR ABROGATING REMAINING PROVISIONS OF SAID ORDINANCE DETERMINING NEED FOR EXTENSION OF DISASTER DECLARATION FOR THE CITY OF SEABROOK

4.3     Consider and take all appropriate action on proposed fiscal year 2017/2018 budget. (Cook)

4.4     Consider and take all appropriate action on the effective tax rate calculation for fiscal year 2017/2018 and proposed tax rate. If tax rate exceeds effective tax rate, take record vote and schedule two (2) public hearings. (Gibbs)
 
4.5     Consider and take all appropriate action for approval of contract for construction services for the installation of a pedestrian pathway with landscape and hardscape amenities between the Seabrook Economic Development Corporation and B&D Contractors Inc. in an amount not to exceed $166,047.04.
